<title>Lessons to be Learned from the Randy Moss restraining order filing</title>

<description>&lt;div&gt;On January 14, 2008 a friend of the New England Patriot wide receiver Randy Moss filed for a restraining order against him.&amp;nbsp; The filing begs certain questions that are important to consider when a party is either going to request a restraining order or must defend against one that has been filed.&amp;nbsp; A sampling of the relevant considerations are as follows:&lt;/div&gt;&lt;ul&gt;&lt;li&gt;If there is a gap in time between when the incident occurred and when the Petitioner filed, can the gap in time be explained? (i.e. I was scared to file or I went to the police to file the next day and a few days later they reccommended I get a civil restraining order as opposed to a criminal one).&lt;/li&gt;&lt;li&gt;If the Petitioner alleges an injury occurred, can the injury be proven?&amp;nbsp; (i.e. are there photos of the injury, medical records, or witnesses that saw injuries?).&lt;/li&gt;&lt;li&gt;If the Petitioner alleges the other party made a threat, is the statement credible and could the Respondent have followed through on the threat?&amp;nbsp; (i.e. if the Petitioner says a threat was made by the Respondent but there is no realistic way Respondent could have followed through on that threat, then how scared could the Respondent have been - if I say I&apos;m coming over to strangle you but you live 2000 miles away and dont know where you live and I weigh 105 pounds and you weigh 190 is it reasonable to assume that I can act out on my threat?&amp;nbsp; Not likely.&lt;/li&gt;&lt;/ul&gt;&lt;div&gt;If you have been threatened or harmed and need to file for protection or you believe that you have been accused wrongly call someone who has experience in doing both.&amp;nbsp; The Law Offices of Paul St. Amant has taken these exact issues to trial many times over and received positive results for many clients.&lt;/div&gt;</description>

<title>Spector Mistrial</title>

<description>A&amp;nbsp;mistrial was declared in the Phil Spector trial last week.&amp;nbsp; The closest the jury got was 10-2.&amp;nbsp; There are two real impacts that this has.&amp;nbsp; The first is that someone who most believe to be guilty is walking around town, buying Aqua Net at Walgreens.&amp;nbsp; The other impact is that the State of California (i.e. the taxpayers) gets to fork over another giant pile of money to retry the case.&amp;nbsp; Will this money be well spent?&amp;nbsp; Time will tell, but I do not believe Spector will be so lucky the second time around.</description>

<title>Riverside Getting a Boost in Judges</title>

<description>For anyone attempting to go to trial in Riverside County you may have realized it is very slow going.&amp;nbsp; Although there are several reasons, one of the problems is getting some attention.&amp;nbsp; Since 1989 Riverside County has added approximately 2 million residents, but only 3 Judges.&amp;nbsp; To aid in resolving that problem, a dozen retired Judges were asked back to action until the backlog of trials that have been getting put off comes back to a reasonable number.&amp;nbsp; Although this is not the ideal solution, it is definitely an improvement upon what had been happening, which was simply telling litigants that they were not going to get a trial any time soon.&amp;nbsp; We shall see how this helps and you can check back here for an update.</description>
